The Ministers of State Chief of Staff of the Presidency of the Republic, Justice and Public Security, Health and Infrastructure, in compliance with the determinations of the Federal Supreme Court and the Opinion of the General Advocacy of the Union, published today morning the Ordinance n° 666 on January 20, 2022, providing for exceptional and temporary measures for entry into the country, of travelers of international origin, Brazilian or foreign, due to the risks of contamination and dissemination of Coronavirus SARS CoV-2 (COVID-19).
There is no indication of validity for such a measure, which means that this Ordinance is in effect until new measures are established.
The most relevant change was the end of the restriction on the entry of international flights and foreign travelers to Brazil, coming from or passing through the Republic of South Africa, Republic of Botswana, Kingdom of Eswatini, Kingdom of Lesotho, Republic of Namibia and Republic of Zimbabwe .
The restrictions referred to in this Ordinance do not apply to cargo transport workers, provided that they use personal protective equipment (PPE) and adopt the measures, in national territory, to mitigate COVID-19 contagion provided for in Ordinance GM/MS 1565, of June 18, 2020 and those explained by the National Health Surveillance Agency.
Important: the documents required by this Ordinance and issued abroad must be presented in Portuguese, Spanish or English. If it is issued in another language, although it is omitted in this standard, it is recommended to present the translation of this exam in Portuguese, Spanish or English, in order to avoid any setbacks during boarding to Brazil.
AIR TRANSPORT
The traveler of international origin, Brazilian or foreign, must present to the airline responsible for the flight, before boarding, a document proving the performance of a test to screen for the infection by the SARS-CoV-2 (covid-19) coronavirus, with a negative result or non-detectable, of the antigen test type, performed within 24 (twenty-four) hours prior to the time of shipment, or RT-PCR laboratory test, performed within 72 (seventy-two) hours prior to the time of shipment, observing the following criteria: I - Evidence document of conducting a Laboratory Test (RT-PCR), for screening for infection by SARS-CoV-2, with a negative or undetectable result, issued in a laboratory recognized by the health authority of the country of origin. - Children under the age of twelve who are traveling accompanied are exempt from presenting a document evidencing a laboratory test for the screening of infection by Coronavirus SARS-CoV-2 (Covid-19) provided that all accompanying persons present documents with a negative result or non-detectable, of the RT-PCR laboratory type performed up to 72 (seventy-two hours) prior to the time of shipment, or antigen test, performed within 24 (twenty-four) hours prior to the time of shipment; - Children aged two or over and under twelve who are traveling unaccompanied must present documents with a negative or undetectable result, of the RT-PCR laboratory type carried out within 72 (seventy-two) hours prior to the time of boarding, or antigen test, carried out within 24 (twenty-four) hours prior to boarding; and - Children under the age of two years are exempt from presenting a document evidencing a test for screening for Coronavirus infection, for travel to Brazil. II - The entry into national territory of individuals who had covid-19 in the last 90 (ninety) days, counted from the date of onset of symptoms, who are asymptomatic and persist with detectable RT-PCR or antigen test for SARS-CoV-2 (covid- 19), will be allowed upon presentation of the following documents: - 02 (two) detectable RT-PCR results, with an interval of at least 14 days, the last one being performed within 72 hours prior to the time of shipment; and - medical certificate declaring that the individual is asymptomatic and able to travel, including the date of travel. The certificate must be issued in Portuguese or Spanish or English and contain the signature of the responsible physician. III- In the event of flights with connections or stopovers where the traveler remains in a restricted area of the airport, the deadlines of 24 (twenty-four) of antigen performance and 72 (seventy-two) hours of the RT-PCR will be considered in relation to boarding the first leg of the trip; IV - In the event of a flight with connections or stopovers in which the traveler does not remain in a restricted area of the airport, and/or performs migration, and which exceeds seventy-two hours since the completion of the RT-PCR test or twenty-four hours of the antigen, the traveler must present a document proving the performance of a new test, RT-PCR or antigen, with a negative or non-detectable result for the SARS-CoV-2 coronavirus (covid-19) at check-in for boarding to the Federative Republic from Brazil; V - Presentation to the airline responsible for the flight, before boarding, of proof, printed or electronically, of the completion of the Traveler's Health Declaration (DSV), within 24 (twenty four) hours prior to boarding to Brazil, with the agreement on the sanitary measures that must be complied with during the period in the country. VI - Presentation to the airline responsible for the flight, before boarding, of proof of vaccination, printed or electronically. The presentation of proof of vaccination will be exempted to travelers:
with a health condition that contraindicates vaccination, provided that it is certified by a medical report;
ineligible for vaccination due to age, according to criteria defined by the Ministry of Health in the National Plan for the Operationalization of Vaccination against COVID-19 and published on the Ministry of Health website;
on account of humanitarian issues;
from countries with low vaccination coverage published by the Ministry of Health and published on the Ministry's website; and
Brazilians and foreigners residing in Brazilian territory, who are not fully vaccinated.
Travelers exempt from proof of vaccination, upon entering Brazilian territory, must undergo quarantine for 14 (fourteen) days in the city of their final destination and at the address registered in the Traveler's Health Declaration (DSV). The aforementioned quarantine can be discontinued through a negative result of RT-PCR or an antigen test performed on a sample collected from the 5th (fifth) day after the beginning of the quarantine, as long as the traveler is asymptomatic.
The acceptance of the quarantine terms by travelers will be expressly included in the Traveler's Health Declaration (DSV).
The information of travelers subjected to quarantine measures, specified in Traveler's Health Declaration (DSV) will be forwarded to the Centers for Strategic Information in Health Surveillance (CIEVS) - National, which will send them to the CIEVS in their catchment areas, which will monitor the respective travelers.
Brazilians and foreigners residing in Brazil, who left the country until December 14, 2021, are exempt from presenting proof of vaccination or quarantine on return, but must present to the airline responsible for the flight, before boarding:
document proving the performance of a test for the screening of infection by the SARS-CoV-2 coronavirus (covid-19), with negative or undetectable result, of the antigen test type, carried out within 24 (twenty-four) hours prior to the time of shipment, or RT-PCR laboratory test, carried out within 72 (seventy-two) hours prior to shipment; and
proof, printed or electronically, of completing the Traveler's Health Declaration (DSV), within a maximum of 24 (twenty-four) hours prior to departure to the Federative Republic of Brazil, with the agreement on the sanitary measures that must be complied with during the period wherever you are in the country.
Aircraft crew will present proof of vaccination, printed or electronically. Aircraft crew members who are not fully vaccinated will comply with the protocol contained in this Ordinance. Aircraft crew members are exempt from presenting a document evidence of the performance of a test to screen for SARSCoV-2 coronavirus infection (covid-19).
GROUND TRANSPORTATION The entry into the country, by land, of the traveler of international origin, Brazilian or foreign, is authorized, provided that is presented at the terrestrial control points proof of vaccination. Proof of vaccination must be presented, as a condition for boarding, to those responsible for international road and rail passenger transport services. The requirement to present proof of vaccination does not apply:
I - the traveler with health condition that contraindicates vaccination, provided that it is certified by a medical report;
II - those ineligible for vaccination due to age, according to criteria defined by the Ministry of Health in the National Plan for the Operationalization of Vaccination against COVID-19 and published on the Ministry of Health website;
III - coming from countries with low vaccination coverage published by the Ministry of Health and published on the Ministry's website; and
IV - the reception of people in a situation of vulnerability resulting from a migratory flow caused by a humanitarian crisis to carry out emergency assistance measures in the Brazilian territory, according to the means available, provided that the situation of vulnerability is recognized by an act of the President of the Republic , pursuant to the sole paragraph of art. 3 of Law No. 13.684, of June 21, 2018, and in compliance with current immigration legislation;
V - the entry of a traveler into the country in a situation of vulnerability to carry out cross-border humanitarian actions, previously authorized by the local health authorities;
VI - the traffic of border residents in twin cities, upon presentation of a border resident document or other supporting document, provided that reciprocity in the treatment of Brazilians by the neighboring country is guaranteed, except in border locations where the measures to welcome people in situations of vulnerability resulting from a migratory flow caused by a humanitarian crisis; and
VII - to the cargo transport worker, including the driver and assistant, provided that such workers prove that they have adopted personal protective equipment (PPE) and the measures to mitigate contagion explained by ANVISA.
WATER TRANSPORTATION
The waterway transport of passengers, Brazilians or foreigners, will be authorized exclusively in Brazilian jurisdictional waters of cruise liners.
The authorization of the waterway transport of Brazilian or foreign passengers, of cruise liners and the operation of vessels carrying passengers, in national ports, is subject to: I - previous edition of the Ordinance by the Ministry of Health, which should provide for the epidemiological scenario, the definition of situations considered to be Covid-19 outbreaks on vessels and the conditions for complying with the quarantine of passengers and vessels; II - edition of an Operationalization Plan within the scope of the Municipality and the State, which establishes the conditions for health assistance for passengers disembarked in their territories and for the local execution of active epidemiological surveillance. III - The sanitary conditions for the embarkation and disembarkation of passengers and crew on cruise ships located in Brazilian jurisdictional waters, including those with foreign crew and without passengers on board from another country, will be defined in a specific act of the National Health Surveillance Agency (ANVISA).
The conditions for embarking passengers on vessels located in Brazilian jurisdictional waters, with foreign crew and without passengers on board from another country, will be defined in a specific act of the National Health Surveillance Agency (ANVISA).
For the purposes of this Ordinance, the traveler who has completed the primary vaccination schedule at least 14 (fourteen) days before the date of departure, provided that:
I - immunizing agents approved by the National Health Surveillance Agency or by the World Health Organization or by the authorities of the country where the traveler was immunized are used;
II - the vaccine vouchers contain, at a minimum, the name of the traveler and the following vaccine data:
a) Trade name or manufacturer's name;
b) Lot number(s) of the applied dose(s); and
c) Date(s) of application of the dose(s).
Proofs of vaccination will not be accepted in which the above data is only available in QR-CODE format or any other coded language; as well as COVID-19 recovery certificates will not be accepted in place of proof of complete vaccination.
The restrictions, measures and conditions provided for in this Ordinance are requirements for the entry of travelers into the country, without prejudice to others suitable for their migratory status, including the requirement to carry an entry visa, when this is required by the Brazilian legal system.
The immigration authority must prevent the entry into Brazilian territory of foreigners who do not comply with the requirements set forth in this ordinance, and may request technical information from other border inspection authorities, if necessary.
Failure to comply with these measures will result in civil, administrative and criminal liability, as well as repatriation or immediate deportation and/or the disqualification of refuge requests.
The immigrant in a situation of vulnerability resulting from the flow immigration caused by a humanitarian crisis, recognized by an act of the President of the Republic, and who entered the country from March 18, 2020 until the date of publication of this Ordinance, may have their migratory status regularized under the terms of current legislation, from that presents proof of vaccination, printed or electronically.
Other normative acts and technical guidelines may be prepared by the Ministries, complementary to the provisions contained in this Ordinance, provided that the scope of their competences is observed.
The Ministries may forward to the Civil House of the Presidency of the Republic, in a reasoned manner, cases not covered by this Ordinance and requests for exceptional cases, regarding the fulfillment of sanitary determinations, to serve the public interest or humanitarian issues.
The documents and other requirements necessary for entry into national territory may be evaluated by the immigration authorities, or at any time, by the other Brazilian authorities, the offender being subject to the penalties provided for in this Ordinance.
Ordinance n° 663 on December 20, 2021 is revoked.
